Terms of Service

These Terms are legal agreement between User (“you”, “your”, etc) and Zerobit Corp. (“Service Provider”, “Service”) for the services you subscribe to.

These Terms of Service apply at all times during the use of the Zerobit E-mail Service.

Member Account, Password, And Security

You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account.

WARNING: IF YOU FORGET YOUR PASSWORD, THERE IS NO WAY WE CAN ENABLE YOU TO REGAIN ACCESS TO YOUR ACCOUNT.

The Service cannot be held liable for any damages or losses arising out of your loss of or failure to remember your password.

Expiration and renewal

When the payment term expires, the account will be put in quarantine state. If the User pays the applicable fee within 15 days after expiration, the account will be reinstated.

Before expiration, Service Provider will provide multiple messages by e-mail, in order to remind the User of the upcoming expiration of the account, and of the option of providing payment to maintain the use of the Service.

If the User does not pay the required fee 15 days after the start of the quarantine period, the account will be deleted.

Prices

We reserve the right to review and modify prices at any time. Updated prices will be published on our website.

Acceptable Use Policy

You may use your account for any legitimate purpose. Use of a Zerobit e-mail account for the purpose of sending unsolicited bulk email, viruses, spam, or fake emails where the sender email contains an account or domain that you don't own, or engaging in Internet fraud or any other illegal activity will result in immediate termination of the relevant account without refund or warning.

You shall remain solely responsible for your use of Zerobit services and will also be liable for any damages that may be incurred. You are also responsible for any and all content which is displayed, downloaded, uploaded or transmitted through your account.

It is your responsibility to ensure that the contents of your account do not violate any federal or local laws applicable to our servers, located in Zurich, Switzerland. You agree to indemnify us against any claim or action and any damage, cost and expense incurred thereby as a result of a breach of any applicable laws.

SPAM Policy

Our spam policy is “zero-tolerance”. Anyone found to be generating spam from within our system will have their account terminated immediately.

Privacy Policy

It is the Service Provider's policy to respect the privacy of its members. We take every possible precaution to ensure that your personal information is kept confidential.

We do not request or require any identifiable personal information when you create an account.

The Service Provider will not monitor, edit, or disclose any personal information about you (including your credit card information) or your use of the Service, including its contents, without your prior permission unless required or allowed by law, or where the Service Provider has a good faith belief that such action is necessary to: (1) conform to legal requirements or comply with legal process; (2) protect and defend the rights or property of the Service Provider; (3) enforce the TOS; (4) act to protect the interests of its members or others; or (5) facilitate a change of control of the Service Provider or the acquisition of the Service Provider's business by a third party, and to enable that third party to continue to provide the Zerobit services to you.

You agree that the Service Provider may access your account, including its contents, as stated above or to respond to service or technical issues.

We use 'cookies' to store session information when you log in to the secure webmail system, and within the shopping cart. We do not use these cookies to track your activity on other websites.

The abuse of our mail servers or of the service for the purpose of sending unsolicited junk mail, or for any fraudulent or criminal activity, will invalidate all privacy guarantees for the account(s) concerned.

Risk of Loss or Damage to your Data

The risk of loss or damage to your Content/data transmitted through the Service will at all times remain with you. Customers are strongly advised to maintain full up-to-date backups of their mailboxes and messages stored at Zerobit at all times. The Service does not maintain backups of customer email and will not be in a position to help in the case of accidental deletion of messages for any reason. You agree to hold Zerobit blameless for loss of access to messages or mailboxes due to any reason.

Access to email addresses at domains registered by Service Provider is a privilege provided at the sole discretion of Service Provider and may be terminated at any time. Customers are strongly advised to use email addresses at their own domains if they wish to ensure long-term continuity of access to these email addresses. Service Provider is not obligated in any way to provide continuity of access to an email address at any domain that is registered by Service Provider.

Modifications to service

The Service Provider reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that the Service Provider shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

You agree that the Service Provider has no responsibility or liability for the deletion or failure to store or transmit any email data or other Content maintained or transmitted by the Service. You acknowledge that the Service Provider reserves the right to delete accounts that are inactive for an extended period of time. You further acknowledge that the Service Provider reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.

Ending the Service

At any time, we may terminate the Service to you without assigning any reason upon giving notice to you by E-Mail. At any time, you may terminate the Service by giving us notice by E-Mail. Terminating the Service does not constitute or create the right to ask for repayment or refund of (all or part of) the subscription fee.

Service Provider reserves the right to refuse service to anybody. Service Provider will refuse service to customers for inappropriate behavior including but not limited to: violations of the Acceptable Use Policy; placing inordinate demands on limited customer support resources; the use of rude, abusive or threatening language in communications with Service Provider Customer Support; publishing or posting false, libelous, malicious or defamatory comments about Service Provider or Service Provider services. If an account is activated and used when service is refused or terminated for inappropriate behavior, no refund will be issued.

Refund policy

The Service is pre-paid yearly subscription. Refunds will be only issued if the request for cancellation is sent within 24 hours of the paymet, and the account has not been accessed.

Any refunds are at the sole discretion of the Service Provider.

The Service Provider may choose to make a refund at its sole unfettered discretion, however the Service Provider shall have no obligation to refund any portion of any payments, in the event that You wish to discontinue use of all or part of the Service, or in the event that your access is terminated by the Service Provider.

Exclusion of warranties

ZEROBIT CORP. PROVIDES THE SERVICE AND THE WEBSITE “AS IS” AND “AS AVAILABLE”, WITHOUT ANY WARRANTY OF ANY KIND. TO THE EXTENT PERMITTED BY APPLICABLE LAW, ZEROBIT CORP. DISCLAIMS ANY IMPLIED WARRANTIES OR REPRESENTATIONS. ZEROBIT CORP. EXPRESSLY DOES NOT REPRESENT OR WARRANT THAT THE ZEROBIT E-MAIL SERVICE WILL MEET YOUR REQUIREMENTS, WILL BE AVAILABLE, UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED.

We do not represent or guarantee that access to the Service will be uninterrupted or error free. You acknowledge that the Service may be affected by outages, faults or delays. Such outages, faults or delays may be caused by factors, including technical difficulties with the performance or operation of our or another person’s software, equipment or systems, traffic or technical difficulties with the Internet or infrastructure failures. In addition, we accept no liability for any failure to comply with this Terms where such failure is due to circumstances beyond our reasonable control.
